Designers

In accordance with Section 65(1) of the BbgBO, building plans for the construction and alteration of buildings must be drawn up by a drafter who is authorised to prepare such plans. This does not apply to building plans for minor or technically simple building projects, which are usually drawn up by skilled tradespeople (in particular master craftsmen and women in the fields of bricklaying, concrete work and carpentry). However, even for these building projects, compliance with the requirements for structural stability, fire protection, sound insulation and vibration control must be demonstrated by qualified and listed specialist planners, or the structural engineering verifications must be examined by a recognised inspecting engineer under the supervision of the building authorities.

The designer must possess the necessary expertise and experience to prepare the relevant construction project and is responsible for the completeness and suitability of their plans. They must ensure that the detailed drawings, calculations and instructions required for the execution of the works comply with public law regulations.

In the case of special structures, the verification of structural evidence of energy savings and the use of renewable energies may be carried out either by the inspecting engineer or by an inspection expert recognised by the building authorities for energy-efficient building design (Section 51(2) BbgBO).

In the cases covered by Section 66 of the BbgBO, where the structural stability documentation is not subject to building authority verification, the structural stability documentation must be prepared by a qualified structural engineer who meets the requirements set out in detail in the regulation.

Yes! The Brandenburg Building Regulations (Section 48(4)) generally stipulate the obligation to install smoke alarms in flats and residential buildings.

In dwellings, living areas (excluding kitchens) and corridors through which escape routes from living areas pass must each have at least one smoke alarm. This must be installed, fitted and operated in such a way that it detects and signals smoke from a fire at an early stage, in accordance with its intended purpose. For this reason, smoke alarms are mostly mounted on the ceiling. The Brandenburg Building Regulations do not contain any specific provision regarding the ‘location’ of the smoke alarm within the room in question; factors such as the shape, size and layout of the room play a role here. Guidance on the positioning of smoke alarms can be found in DIN 14676 ‘Smoke alarms in residential buildings, dwellings and rooms used for residential purposes’.

The use of battery-operated, low-cost smoke alarms is sufficient under building regulations. The manufacturer’s installation and operating instructions must be followed. However, only smoke alarms that are approved in accordance with the Construction Products Regulation may be used. The minimum requirements are set out in the harmonised European product standard EN 14604. All smoke alarms must be certified in accordance with this standard.

There is no statutory monitoring or supervisory system in place to ensure compliance with the smoke alarm requirement. Retrofitting, installation and maintenance are the sole responsibility of the respective owners.

The buildings mentioned are classified as special-purpose buildings within the meaning of Section 51 of the BbgBO. The relevant requirements for preventive fire safety in these cases are set out in specific special-purpose building regulations or guidelines.
